Rental Agreement

This Rental Agreement governs each rental transaction between an Owner and a Renter on Swaple. By accepting this agreement during booking, both parties agree that this agreement applies to that booking. This agreement is between users; Swaple remains a marketplace platform and is not the owner or renter of listed items.
1. Parties and Scope
The parties to this agreement are: (a) the Owner who listed the item, and (b) the Renter who books the item. This agreement applies only to the specific booking and dates shown in the booking record.
2. Condition at Pickup
At pickup, the Renter should inspect the item and confirm condition before taking possession. The Owner should disclose known defects or limitations. Photos, messages, and listing details may be used to determine item condition at pickup.
3. Care, Use, and Restrictions
The Renter agrees to use the item lawfully, carefully, and only for its intended purpose. The Renter must not sub-rent, transfer possession to an unauthorized person, or modify the item without written Owner consent.
4. Loss, Damage, and Theft
The Renter is responsible for loss, theft, missing parts, and damage occurring during the rental period, except for normal wear and tear. Repair, replacement, and related costs may be charged according to platform policy and applicable law.
5. Deposits and Additional Charges
Where applicable, security deposits are authorized and held through Stripe. By accepting this agreement, the Renter authorizes deposit application for eligible claims, including damage, missing accessories, excessive cleaning, and unpaid late fees.
6. Return Timing and Late Returns
The Renter must return the item by the agreed return time and in substantially the same condition as received. Late returns may incur additional charges, including extension fees, loss-of-use amounts, and reasonable recovery costs.
7. Prohibited Items and Illegal Use
The item may not be used for unlawful activity or in violation of listing restrictions. Either party may cancel handoff if they reasonably believe misuse, fraud, or safety risk is present.
8. Disputes Between Parties
Owners and Renters are primarily responsible for resolving disputes between themselves. Swaple may provide transaction records and communication logs but is not a guarantor of either party's performance.
9. Platform Terms Still Apply
This agreement is in addition to Swaple's Terms of Service and Privacy Policy.
