Terms of Service

Swaple is a peer-to-peer marketplace that allows individuals ("Owners") to list items for rent or sale, and other individuals ("Renters" or "Buyers") to discover and transact with them.

We are a marketplace platform only. Swaple is not a party to any rental or sale agreement between users. We do not own, inspect, insure, or guarantee the condition of any listed item. We are not responsible for the actions or omissions of any user.

You must be at least 18 years old to use Swaple. By using the Platform you represent that you meet this requirement. We reserve the right to suspend accounts where eligibility cannot be verified.

You must provide accurate, current, and complete information when creating an account, including via our supported identity provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@swaple.net if you suspect unauthorized access.

Owners are solely responsible for the accuracy of their listings, pricing, condition descriptions, and availability. By listing an item, you represent that you have the legal right to rent or sell it.

Renters and Buyers are solely responsible for ensuring a listed item meets their needs before booking. You are encouraged to communicate with the Owner and ask questions prior to any transaction.

All agreements regarding rental terms, pickup, return, damage, and disputes are solely between Owners and Renters/Buyers. Swaple does not arbitrate disputes and provides no guarantee of performance by either party.

Swaple charges a service fee to Renters/Buyers and a payout fee to Owners. Current fees are described on our Pricing page. Fees are subject to change with reasonable notice. Security deposits and cleaning fees are set by Owners and collected by Swaple as a pass-through; Swaple does not retain these amounts.

All payments are processed through Stripe. Owners must connect a Stripe Express account to receive payouts. By connecting your bank account you agree to Stripe's Connected Account Agreement.

Swaple does not store full payment card details. All payment information is handled by Stripe in accordance with PCI-DSS standards.

Swaple may offer optional identity verification through Lynk ID or other providers. Verification status is displayed on user profiles as a trust signal only. Verification does not constitute an endorsement by Swaple, and verified users remain solely responsible for their own conduct.

You agree not to:

• List items you do not have the legal right to rent or sell
• Provide false or misleading information in listings or communications
• Use the Platform for any unlawful purpose
• Circumvent Swaple's payment system (off-platform transactions are prohibited)
• Harass, threaten, or discriminate against other users
• Attempt to gain unauthorized access to the Platform or other users' data
• Use automated tools to scrape or abuse the Platform

Violation of these rules may result in immediate account suspension.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SWAPLE MAKES NO WARRANTIES REGARDING THE ACCURACY OF LISTINGS, THE FITNESS OF ITEMS FOR ANY PURPOSE, OR THE CONDUCT OF ANY USER. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY LAW, SWAPLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGE TO OR LOSS OF PROPERTY, PERSONAL INJURY, OR LOSS OF PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SWAPLE'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO SWAPLE IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) $100.

You agree to indemnify and hold harmless Swaple and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your listings or transactions, or your violation of these Terms.

Swaple may suspend or terminate your account at any time for violations of these Terms or for any other reason with reasonable notice. You may close your account at any time by contacting us. Termination does not relieve you of obligations arising from prior transactions.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
